3. BYD TERMS AND CONDITIONS FOR TRAVEL
The following stipulations have been defined by BYD itself. With the exception of any variations permitted in the terms and conditions itself, these self-defined stipulations cannot negatively affect the ANVR terms and conditions for travel, and their sole purpose is to strengthen the position of the consumer.
- Travel documents
The passenger’s name on the airline ticket has to be the same as the name in his or her passport. If the names are not the same, the airline company has the right to refuse the passenger. BYD is not liable for costs resulting from the issuing of new tickets.
Prior to or during the booking, BYD will give the necessary general information about the required travel documents. However, it is the responsibility of the passenger himself or herself to ensure that on departure and during the trip he or she is in possession of the right documents.
For some destinations also visa or tourist card requirements apply. For flights with a stopover in the USA or with the USA as a final destination, the passenger has to apply for ESTA in order to visit the USA without a visa. It is the responsibility of the passenger himself or herself to obtain permission to visit the USA.
Without correct and valid travel documents the passenger will be refused entry by the immigration authorities in question. For passengers who are not in possession of the Dutch nationality other requirements may apply. If the trip cannot go ahead because the passenger does not have the required travel documents, the normal cancellation conditions apply. BYD is not liable for any loss resulting from the failure of a passenger to have the right travel documents.
- Deposit
When concluding the agreement with BYD a deposit of 15 % of the total agreed travel sum has to be paid. The remainder of the travel sum has to be received by BYD at the latest six weeks before the departure date. The passenger is in default if he or she does not pay on time. If the passenger has not paid on time, BYD will send him or her a payment reminder at no extra charge, stating that the passenger has fourteen calendar days to pay the amount due. If the passenger still hasn’t paid after fourteen days, the agreement is deemed to be cancelled on the day of default. In that case, BYD reserves the right to charge any cancellation costs due. Any deposits will be set off against the cancellation costs.
If the agreement is reached within 6 weeks before the day of departure, the full travel sum has to be paid at once.
- Cancellation by the passenger
If the passenger cancels an agreement, BYD will charge apart from possible booking costs due, the following cancellation costs:
In case of cancellation up to the 42nd calendar day (exclusive) before the day of departure: the deposit;
In case of cancellation after the 42nd calendar day (inclusive) up to the 28th calendar day (exclusive) before the day of departure: 35% of the travel sum;
In case of cancellation after the 28th calendar day (inclusive) up to the 21ste day (exclusive) before the day of departure: 40% of the travel sum;
In case of cancellation after the 21st calendar day (inclusive) up to the 14th day (exclusive) before the day of departure: 50% of the travel sum;
In case of cancellation after the 14th calendar day (inclusive) up to the 5th day (exclusive) before the day of departure: 75% of the travel sum;
In case of cancellation after the 5th calendar day (inclusive) up to the day of departure: 90% of the travel sum;
In case of cancellation on the day of departure or later: the full travel sum.
- Minimum number of participants
Some tours, holidays or packages require a minimum number of participants, which, if not reached, means the tour, holiday or package cannot go ahead. The number is specified with the tour, holiday or package in question, as well as the final date on which the tour operator has to cancel.
- Child fares and rates
Children may qualify for a discount if they travel with two adults paying full fare or rates. In some cases children up to 12 years (in some hotels even up to 16 or 18 years) stay for free in the rooms of the parents if the available beds are used. Any additional beds and meals will often have to be paid. The age at the day of arrival at the hotel is decisive for the rate. When booking, the passenger has to inform BYD about the number of accompanying children and their age.
- Insurance
Passengers are advised to take out a proper baggage, accident and cancellation insurance.
- Health regulation
For information about health regulations the passenger is referred to his or her GP, the GGD[4] or the Dutch National Coordination Centre for Travel Advice[5] (www.lcr.nl). BYD is not liable for possible incorrect information provided by these organisations.
- Legal stipulations concerning money laundering and terrorist financing
